XEd Space - Terms and Conditions for programs, including cancellation policy

These terms and conditions contain important information about your registration including our cancellation policy, what happens if we need to change or cancel a course or event, your privacy obligations and our limitation of liability. Please read carefully the applicable terms and conditions for your purchase and registration to ensure you are fully aware of your rights and obligations under these applicable terms and conditions.

Privacy Policy

Our Privacy Policy is available here. By registering for a program or registering your interest in a program, you acknowledge consent to the terms of our Privacy Policy from time to time. If you have provided information about another person to us (e.g. a participant from your organisation) you acknowledge that you have obtained that person's consent to the provision of their information to us. This includes making them aware of our Privacy Policy and our Privacy and Collection Statement, such as by providing links to them.

Participant registration

Registration is subject to receipt of your payment, our confirmation of availability and participant suitability for each program. You must pay any invoice within 7 days of receipt and payment must be received in full before we provide pre-program materials and psychometric instruments and/or program commencement.

If you or your organisation have registered for your participation online, you will be provided with immediate access to course materials subject to receipt of payment.

Registration changes by you

If for any reason you are no longer able to attend the program on the date you have registered for, you may give us a request via email or phone to cancel, or substitute or defer your participation. Please note that a charge may apply.

We deduct any applicable charges from any refund due to you. In addition, any of our materials already provided to you must be returned before we remit any refund and/or confirm a transfer or substitution. 

If for any reason you do not provide us with the required notice or do not attend the course, no refunds are payable and no changes to your enrolment will be accepted. We may review this policy in the case of special circumstances where sufficient evidence is provided.

Cancellation

You may cancel your enrolment altogether. However, you or your organisation may consider substituting another eligible participant or transferring to another course option as further explained below.

Substitution

You may request to substitute another person to register in your place. Only one substitution is permitted per registration. The proposed substitute must review and confirm to us that they meet the enrolment criteria applicable for that course before we will accept the substitution.

Any further substitution request by you or the substitute will be treated as a cancellation and will incur a 100% cancellation charge.

Deferment

If you wish to defer (or transfer) to a different course date you may request to defer your registration. Only one deferment is permitted per registration and the alternative option must be within 12 months of your original course.

A deferment request is subject to availability of the alternative date, course or format in your request and may incur additional fees. You will be contacted to confirm your new event, or we will place you on a waitlist if the alternative option is not available at the time of your request.

Any further deferment request will be treated as a cancellation and will incur a 100% cancellation charge.

Any differences in the registration cost will be payable by you or your organisation or refunded by us as applicable and subject to any charge as explained below.

• 19 days’ notice or less, the total program fees are payable and no refund applies.
• 15 business days’ notice or more, a substitution charge of $250 to cover administration costs is payable.
• 14 business days’ notice or less, substitutions are not permitted.
• 10 business days’ notice or more, a deferment charge of $250 to cover administration costs is payable.
• 9 business days’ notice or less, deferments are not permitted.
CCL Lead 4 Success Program® • 10 business days’ notice or more, total program fees are refundable less a $150 administrative fee.
• 9 business days’ notice or less, the total program fees are payable and no refund applies.
• 10 business days’ notice or more, a substitution charge of $150 to cover administration costs is payable.
• 9 business days’ notice or less, substitutions are not permitted.
• 5 business days’ notice or more, a deferment charge of $250 to cover administration costs is payable.
• 4 business days’ notice or less, deferments are not permitted.
CCL Leading for Organizational Impact • 20 business days’ notice or more, total program fees are refundable less a $250 administrative fee.
• 19 business days’ notice or less, the total program fees are payable and no refund applies.
• 15 business days’ notice or more, a substitution charge of $250 to cover administration costs is payable.
• 14 business days’ notice or less, substitutions are not permitted.
• 10 business days’ notice or more, a deferment charge of $250 to cover administration costs is payable.
• 9 business days’ notice or less, deferments are not permitted.

We exclude weekends, public holidays and the first day of a course (course start date) when calculating how many days’ notice you have provided for any requested changes to your enrolment.

Enrolment changes by us

If we are required to cancel or vary program dates or locations, including due to insufficient course enrolments and Covid-19 related disruptions, you will be offered a full refund of the total program fee, or a substitution or deferment, which will not be treated as a request by you for the limits specified above.

However, unless required by an applicable law, we will not be responsible for any airfare, hotel or any other direct or indirect costs or losses incurred by participants in any circumstances and you are strongly encouraged to take this into account when booking travel arrangements.

Limitation of Liability

Our contact is with the client registering for our programs; it does not create a relationship with others, including the participants provided in your registration. You agree that our liability for any loss or damage suffered by you arising out of the goods and services we provide, including liability for any negligent act or omission or misrepresentation, will be limited to our fees in respect of the relevant goods and services.

However, if consumer guarantees apply, our liability to you will be limited to either of the following (at our option):

  1. the supply of the goods or services again, or
  2. the payment of the cost of having the services supplied again.

Nothing in these terms excludes, restricts or modifies the application of the provisions of any statute (including the Competition and Consumer Act 2010) where to do so would contravene that statute or cause any of these terms to be void.

Liability includes in contract, in tort, by virtue of any statute or otherwise and “loss or damage” includes loss or damage incurred directly, indirectly or consequentially but excludes any such loss or damage arising from any fraudulent or unlawful conduct on our part.

If you have provided information about another person to us (e.g. a participant from your organisation) you acknowledge to us that you have obtained that person’s consent to the provision of their information in accordance with your privacy policy.
